First Circuit Allows New Lawsuit After Declaratory Judgment

SRBC discusses the First Circuit's recent decision in Andrew Robinson Int'l, Inc. v. Hartford Fire Ins. Co. that an insured who prevailed in a declaratory-judgment action against its insurer could then start a new lawsuit alleging violation of unfair claims-handling statutes.  The court predicted that Massachusetts would adopt an exception to the rule ordinarily barring such "claim splitting."  Follow the link below to read more.
