Regina Roman: Who's The Client? SRBC managing partner Regina Roman will appear on a panel of three experts at a May 10 Massachusetts Continuing Legal Education program entitled "Who's The Client? Business & Litigation Ethics."
Regina, who currently serves as a member of the Massachusetts’s Supreme Judicial Court’s Standing Advisory Committee on the Rules of Professional Conduct, and as Co-Chair of the Boston Bar Association’s Ethics Committee, will be joined on the panel by Neil Motenko of Ropes & Gray and Robert Buchanan of Choate Hall & Stewart.
MCLE says about the program: "The first step in taking in a new engagement is to determine who the client is and whether engagement with the client is appropriate from the standpoints of conflicts, sound intake procedures, and risk analysis. This program features three experienced business litigators and ethics counsel who discuss key questions that often arise in vetting new clients.
Hear the expert panelists discuss common, but often complicated, questions such as:
- Is the client confined to the person or entity at issue? Or, does it include affiliates or related parties in the same "corporate family"?
- When does interaction with a "prospective" client raise conflicts issues?

- How can terms of engagement help you manage these issues?
- What are the conflicts, ethics, and liability risks of failing to be careful about taking in new clients?
- In joint representations, what must you consider in identifying who is-and who is not-in the client group?
- What must a firm's database reflect, and how must it be updated, to reflect the client appropriately and to vet ethical and business conflicts? What are the consequences of inadequate data?
